Terms of Use
DRAFT FOR LEGAL REVIEW — not yet in force. Text in [square brackets] is a placeholder or a question for the lawyer. Nothing here is legal advice.
Last updated: [date] · Version: 0.1 (draft)
1. About these terms
These terms apply to everyone who uses Learnwise — a learning portal for schools, run by [LEGAL ENTITY NAME, address] ("we", "Learnwise Academy" or "Learnwise"). Learnwise is provided to a school under an agreement with that school. You use Learnwise because your school has given you an account. If you are a student, a parent or guardian should read these terms with you.
By signing in you agree to these terms. If you do not agree, please do not use Learnwise and tell your school.
2. Accounts
- Accounts are created by your school (or by us for the school's administrator). There is no self-registration.
- You sign in with a school code, your login ID (students: roll number) and a password. Your first password is temporary: change it the first time you sign in. A temporary password stops working after 7 days; ask your School Administrator to reset it.
- Keep your password private. Do not share it, and do not sign in as someone else. You are responsible for what is done with your account.
- Students can sign in only after the school has recorded parental consent. If you see a message about consent, please contact your school office.
- The School Administrator can deactivate or remove accounts. We may suspend an account if needed to protect the service or other users.
3. What you may do
- Students attempt the worksheets their teachers release, read notes, and see their own progress.
- Teachers manage the content and classes assigned to them, publish and withdraw their worksheets, mark written answers, and see their own students' results.
- School administrators manage their school's classes, staff, students and consent records, and see their school's results.
- Everyone may raise a query with the platform team.
4. What you must not do
- Share worksheet questions, answers or other students' information outside your school without permission.
- Try to see another school's, class's or person's data, or to get round Learnwise's security, rate limits or AI limits.
- Copy answers from the system for others, cheat, or submit work that is not your own where the teacher has said it must be.
- Upload or write anything unlawful, abusive, or that infringes anyone's rights.
- Use bots, scripts or automated tools against the service, or try to disrupt it.
- Use Learnwise for advertising or marketing.
5. Content
- Question banks and worksheets created by teachers and administrators belong to the school (or to the person who made them, as the school's own arrangements say). A school's content in Learnwise is visible to that school's teachers and administrators who are assigned to it, and to us for support.
- Learnwise's platform content (software, design, and the platform-wide CBSE syllabus library we maintain) belongs to us or our licensors. [Lawyer: confirm CBSE curriculum material attribution and permitted use; the syllabus list is sourced from CBSE's published curriculum documents.]
- AI-assisted content. Teachers can use AI to draft questions and to suggest marks. AI output can be wrong. A teacher must review it; for written answers the teacher decides the final mark and feedback. Do not rely on AI-written questions without checking them.
- Students' answers belong to the student and the school; we use them only to run the service (see the Privacy Policy).
6. Marks, grading and results
Multiple-choice and fill-in-the-blank answers are marked automatically against the answer the teacher stored; written answers are marked by the teacher. A student's first attempt at a worksheet is the one that counts towards class position and averages; later attempts are practice. Schools may set their own policies on retakes. We take care that grading is accurate, but the school and teacher are responsible for decisions made using results. If you think a mark is wrong, ask your teacher.
7. Availability and changes
We work to keep Learnwise available but do not promise it will never be interrupted; we may carry out maintenance and will try to give notice. We may change or withdraw features. [Lawyer: service levels, if any, belong in the school agreement.]
8. Our responsibility
To the extent the law allows, Learnwise is provided "as is", and we are not liable for indirect or consequential loss, or for loss caused by things outside our control. Nothing in these terms limits liability that cannot lawfully be limited. [Lawyer: draft the limitation and indemnity clauses, and the governing law and courts — probably Indian law and [city] courts. Check consumer-protection implications for services to schools.]
9. Ending use
You may stop using Learnwise at any time. Your school may remove your account. When a student is removed, their record and attempts are deleted (see the Privacy Policy). We may end a school's access in line with its agreement.
10. Changes to these terms
We will tell schools about important changes before they take effect and publish the new version here. Continuing to use Learnwise after that means you accept the change.
11. Contact
Questions about these terms: [email]. Concerns about a child's data: your school office first, then our Grievance Officer [name, email].
Notes for the lawyer (not part of the published terms)
- These terms are between Learnwise and the individual user; the commercial terms sit in the school agreement. Is that the right structure, particularly for children (who cannot contract)? Should a parent/guardian accept on the child's behalf, through the school's consent form?
- Add: acceptable-use consequences, intellectual property wording, indemnity, limitation of liability, governing law, dispute resolution.
- Do we need a separate Terms of Service for School Administrators (they accept responsibilities: consent collection, accurate roster, account safekeeping)? The DPA covers some of this.
- Anything specific to AI features that should be in the terms (accuracy disclaimer, human review)?
